Prenuptial agreement
A prenuptial agreement is an agreement made when one enters a marriage or if substantial changes in married couple´s assets and fortunes appears. Very often the agreement protects a property or a business from being sold and lost for the owner or family in case of divorce. An often seen example is that a family summer house or inheritance received from one of the parties parents is protected with an agreement keeping these assets in the family regardless the success of the marriage.
In other cases the agreement secures that the parties in case of divorce split on terms where they do not have to share their assets and fortune 50/50. It could be in case of marriage between to persons with very different financial situations. In this case the prenuptial agreement could protect both parties in the marriage.
Prenuptial agreements are very used in combination with a last will. It may be that parents prefer inheritance to stay on the hands of their children. It could also be a married couple protecting the one of them who live longest.
At PrivatRevision we often recommend these agreements as one of several tools when planning the family´s fortune and inheritance.
